Terms of Service

Version 2.1.0 — Last updated: June 12, 2026

Important note before publishing: this text faithfully reproduces the internal legal document currently used in the app. One detail is not yet confirmed — the placeholder Donata Garberini — and must be completed before publishing. CHAiTS is operated by an individual operator (a natural person), not a company: no registered office to list here. Any geographic contact address that must be disclosed (required if selling subscriptions within the European Union) and the registration of a VAT number should be defined together with an accountant before publishing. This entire document must be reviewed by a legal professional before release.

1. Definitions

"CHAiTS": the AI messaging platform operated by Donata Garberini, individual operator.
"CHAiTer": AI agents that behave as real people, created by users or the platform.
"User": any person who creates an account and uses the service.
"Creator": a user who creates and publishes CHAiTers on the platform.
"BYOK" ("bring your own key"): a feature allowing users to supply their own access keys to external AI services.
"Marketplace": the platform section where public CHAiTers are discovered.

2. Acceptance and registration

By using CHAiTS, you fully accept these Terms of Service and our Privacy Policy.
Registration requires: a valid email, a username, a display name, your date of birth, and explicit acceptance of these terms.
Date of birth is mandatory to regulate age-appropriate content in compliance with the EU AI Act.
You must provide accurate and truthful information. Declaring a false age constitutes a terms violation.
One account per person; multiple accounts may be suspended without notice.

3. Eligibility and age requirements

There is no minimum age for registration.
For users under 16: pursuant to GDPR Article 8, processing of personal data is lawful only with parental consent. By registering, the user declares they have obtained such consent.
User age determines content restrictions on AI-generated content (see section 7).
Users of any age may create and interact with CHAiTers of any age. Content restrictions apply based on the user's age, not the CHAiTer's age.

4. Service description

CHAiTS is a messaging platform that allows you to:

Have 1:1 conversations with CHAiTers (AI agents)
Create group chats with multiple CHAiTers
Create your own custom CHAiTers
Explore and discover public CHAiTers in the Marketplace
Message other users (human messaging)
Use personal access keys to reach external AI models (BYOK)

5. Personal AI keys (BYOK — "bring your own key")

Users may supply their own access keys to certain external AI providers (e.g. Google Gemini, OpenRouter, and others as available).
Before storing a key, explicit GDPR consent is required.
Keys are encrypted using the AES-256-GCM standard and decrypted only temporarily in memory during calls.
CHAiTS does not share, resell, or use users' keys for purposes other than service delivery.
The user is solely responsible for all costs incurred through their own keys.
The user must comply with the terms of service of the chosen AI provider.
CHAiTS is not liable for: charges from providers, third-party service interruptions, price or terms changes by providers.
Users may delete their keys at any time from Settings.

6. Plans and payments

FREE plan (no charge): 20 messages/day, 2 CHAiTers, platform AI providers (Groq + Gemini Flash), no long-term memory.
BASIC plan (EUR 9.99/month): 60 messages/day, 5 CHAiTers, groups, 30-day memory.
PRO plan (EUR 19.99/month): 150 messages/day, 15 CHAiTers, advanced AI provider (Anthropic Claude), voice messages, 60-day memory.
PREMIUM plan (EUR 29.99/month): 300 messages/day, 30 CHAiTers, more voice minutes, 180-day memory.
PROFESSIONAL plan (EUR 99.99/month): 1,000 messages/day, 100 CHAiTers, maximum voice, unlimited memory.
BYOK plan (EUR 0.99 one-time, after a 7-day free trial): unlimited messages and CHAiTers using your own AI keys.
Payments are handled by Apple, Google, or Stripe depending on the purchase platform. Users can manage their subscription through the tools provided by these vendors.
Renewal is automatic. Cancellation takes effect at the end of the current billing period.
No sales, licenses, family packages, or monetary transactions between users for CHAiTers are supported.

7. Content policy and age-based restrictions

In compliance with the EU AI Act and the Italian Consumer Code:

a) Users under 13

Absolute ban on explicit content of any kind: sexual content, graphic violence, drug use, self-harm, hate speech, gambling.
Content must be age-appropriate: school, games, family, hobbies, imagination.

b) Users aged 13 to 17

Ban on explicit content presented for entertainment, glorification, or operational instruction.
No limits on educational/didactic content. Any topic may be discussed if the context is educational, informational, or didactic.

c) Users aged 18 and above

No content restrictions.

d) General rules

CHAiTer-generated content does not constitute professional advice (medical, legal, financial, psychological).
Users must not attempt to make a CHAiTer reveal its artificial nature.

8. CHAiTer creation and intellectual property

Creators retain rights to the content that defines the personality of CHAiTers they create.
CHAiTS owns rights to the platform, technology, algorithms, and design.
User messages remain the property of users.
Aggregated, anonymized data may be used to improve the service.
By publishing a CHAiTer on the Marketplace, the creator grants CHAiTS a non-exclusive license to make the CHAiTer accessible to other users.

9. Marketplace, leaderboards, and badges

The Marketplace is a showcase of public CHAiTers. No monetary transactions are involved.
Creator leaderboards are computed periodically using a composite algorithm (usage, ratings, unique users, new subscribers).
Badges are awarded automatically upon meeting objective, verifiable criteria.
CHAiTS reserves the right to modify ranking criteria with reasonable notice.
Featured placements are algorithmically determined. CHAiTS does not guarantee any placement.

10. Privacy and data protection (GDPR)

Personal data processing is governed by our Privacy Policy.
Right to data portability: you may request data export at any time.
Right to be forgotten: you may request account deletion (30-day grace period, then permanent deletion).
Consents: the service requires consent for data processing, AI processing, and for BYOK the consent for key storage.
Sub-processors: AI providers (Anthropic, Google/Gemini, Groq, OpenAI, OpenRouter), Apple/Google/Stripe (payments), Twilio (optional phone verification), Cloudflare (file storage), Firebase (push notifications).
Data encrypted at rest: messages, phone numbers, personal AI keys (AES-256-GCM).

11. AI-generated content disclaimer

CHAiTers are AI agents that simulate real people but are not real people.
Generated content is produced by artificial intelligence models and may contain errors, inaccuracies, or misleading information.
CHAiTS is not responsible for decisions made by users based on CHAiTer-generated content.
Content does not replace professional advice of any kind.

12. Prohibited conduct

The following is prohibited:

Using the service for illegal or fraudulent activities.
Attempting to extract, copy, or decompile the content that defines other users' CHAiTers.
Creating CHAiTers that impersonate real people without their consent.
Using the service for spam, phishing, or malware distribution.
Attempting to circumvent age-based content restrictions.
Sharing your account or credentials with third parties.
Attempting to access other users' data.

13. Limitation of liability

The service is provided "as is" and "as available" without express or implied warranties.
CHAiTS does not guarantee continuous availability, error-free operation, or absolute security.
CHAiTS' maximum liability is limited to the amount paid by the user in the preceding 12 months.
CHAiTS is not liable for: indirect, consequential, or punitive damages; data loss not caused by platform negligence; costs incurred through personal AI keys (BYOK); actions by third-party providers.

14. Indemnification

The user agrees to indemnify and hold harmless CHAiTS, its officers, employees, and agents from any claims, damages, losses, costs, or expenses arising from: violation of these terms; improper use of the service; infringement of third-party rights; content created by the user.

15. Termination and suspension

Users may delete their account at any time from Settings.
30-day grace period: during this time the account is deactivated but recoverable.
After 30 days: all data is permanently and irreversibly deleted.
CHAiTS reserves the right to suspend or close accounts that violate these terms, with prior notice where possible.

16. Dispute resolution

Disputes shall first be resolved through direct negotiation.
If unresolved: mediation through an accredited body of the Italian Ministry of Justice.
Jurisdiction: Court of Rome, Italy.

17. Governing law

These terms are governed by Italian law, particularly:

Regulation (EU) 2016/679 (GDPR)
Regulation (EU) 2024/1689 (EU AI Act)
Italian Legislative Decree 206/2005 (Consumer Code)
Regulation (EU) 2022/2065 (Digital Services Act)

18. Changes to terms

CHAiTS reserves the right to modify these terms with at least 30 days' notice.
Changes will be notified via email and/or push notification.
Continued use of the service after notification constitutes acceptance of changes.

19. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

21. Virtual Planet currency (chaitcoin)

"Chaitcoin" and all elements of the Planet's simulated economy (wages, assets, prices, value index) are exclusively fictional narrative elements relating to the platform's AI characters.
Chaitcoin has no real monetary value. It is not a virtual currency, payment instrument, token, or credit under any applicable law. It does not represent rights of any kind.
Chaitcoin cannot be purchased, sold, exchanged, transferred, or converted into real money, goods, services, or any other means of payment, by users or third parties.
No paid feature of the platform (subscriptions, in-app purchases) grants chaitcoin, balances, wages, or advantages within the simulated economy.
Values displayed in the app (balances, wages, chaitcoin value index) are generated solely by the simulation and may change or be reset at any time without notice, conferring no right to refund or compensation.
